Dispute Resolution
Clients have the option of using alternative dispute resolution procedures to resolve disputes.
The European Commission previously provided an online dispute resolution platform (the so‒called “ODR Platform”) for the out‒of‒court settlement of disputes arising from online contracts. The EU ODR Platform has since been discontinued.

1. Scope of Application
These General Terms and Conditions apply to all contracts between Moreofmaja Productions (hereinafter referred to as the “Photographer”) and its clients concerning photographic services, in particular wedding photography, couple shoots and comparable services.
Any terms and conditions of the client that deviate from these Terms and Conditions shall not form part of the contract unless expressly agreed in writing.
2. Conclusion of the Contract
A contract is concluded as soon as the Photographer sends the client a written offer, in particular by email, and the client accepts this offer in text form (e.g. by email, message or comparable confirmation).
Acceptance of the offer constitutes a binding and legally effective booking. A separate signature is not required. Upon conclusion of the contract, these General Terms and Conditions shall become part of the agreement.
3. Date Reservation & Payment
To secure the wedding date, a 50% deposit of the agreed total price is due immediately upon conclusion of the contract. The deposit will be credited towards the total price and serves to exclusively reserve the date for the client.
The remaining balance is due no later than 4 weeks before the wedding date, unless otherwise agreed individually.
If the total amount is paid in full in advance, the Photographer grants a 5% discount on the total price.
4. Cancellation by the Client
The client may cancel the contract at any time. As the wedding date is exclusively reserved for the client and the Photographer may therefore lose other bookings, the following flat‒rate cancellation provisions shall apply:
‒ More than 12 months before the date: refund of 70% of the total price
‒ 12 to 6 months before the date: refund of 50% of the total price
‒ Less than 6 months before the date: refund of 25% of the total price
‒ Less than 8 weeks before the date: refund of 10% of the total price
The above flat‒rate amounts constitute compensation for the reserved date and the resulting loss of profit.
The client remains entitled to demonstrate that no loss or a substantially lower loss has occurred. The Photographer remains entitled to demonstrate that a higher loss has occurred.
5. Postponement of the Wedding Date
Postponement of the agreed wedding date does not constitute a cost‒free cancellation of the contract.
The Photographer will make reasonable efforts to offer an alternative date where possible. There is no entitlement to the availability of an alternative date. If no suitable alternative date can be found, the cancellation provisions shall apply accordingly.
6. Photographer’s Inability to Perform / Substitute Photographer
If the Photographer is unable to perform the agreed services due to illness, accident or force majeure, the client will be informed without undue delay.
The Photographer is entitled to appoint a suitably qualified substitute photographer. The replacement will be selected to the best of the Photographer’s judgment, taking into account a photographic style and quality standard that are as similar as possible.
The client generally agrees to such substitute services. If no suitable replacement is available, any payments already made for services that have not been provided will be refunded. Any further claims shall only exist to the extent provided for by applicable law.
7. Performance of the Photographic Services / Client’s Cooperation
The client shall ensure that all conditions necessary for the performance of the photographic services are in place, in particular:
‒ adherence to the agreed schedule
‒ access to the relevant locations
‒ coordination with other service providers
‒ provision of information regarding the schedule and any special circumstances
In the event of delays to the schedule (e.g. a delayed ceremony or changes to the programme), the Photographer shall not be liable for any resulting limitations to the photographic services.
A reduction of the agreed fee due to organisational delays is excluded. The Photographer is entitled to adapt the photographic work flexibly to the actual course of the event.
8. Artistic Style and Creative Direction
The Photographer works in her own artistic style. The client is not entitled to specific photographs, scenes or complete documentation of individual parts of the programme. The selection and editing of the images shall be carried out at the Photographer’s artistic discretion.
9. Delivery of Images
The finished images will generally be provided within up to 6 weeks after the wedding date. If a different delivery period has been agreed in the individual offer, that period shall take precedence. The images will be delivered digitally via an online gallery or comparable platform.
10. Archiving
The Photographer will make reasonable efforts to retain the final image files for a period of at least 12 months following delivery. There is no obligation to archive the images beyond this period.
11. Image Editing
Only edited image files in the Photographer’s individual style will be delivered. The provision of unedited raw data (RAW files) is excluded.
12. Client Usage Rights
The client receives a simple, non‒exclusive right to use the delivered images for private purposes, without any geographical or temporal limitation.
This includes, in particular:
‒ private use
‒ storage
‒ sharing within the client’s private circle
‒ publication on the client’s private social media channels
Commercial use or transfer of the images to third parties for commercial purposes is only permitted with the Photographer’s prior consent.
13. Photographer’s Right to Publish Images
The client grants the Photographer the right to use images created during the commissioned work for the Photographer’s own promotional purposes, in particular for:
‒ website
‒ portfolio
‒ social media
‒ marketing and self‒promotion
The client may object to the publication of individual images. Any such objection must be communicated to the Photographer in writing before or at the latest after the images have been provided. The Photographer will take legitimate objections into account as far as possible in the context of her use of the images.
14. Liability
The Photographer shall only be liable for damages caused intentionally or through gross negligence. For technical failures, data loss or unforeseeable events, the Photographer shall only be liable to the extent required by applicable law.
15. Final Provisions
Should any individual provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
German law shall apply.
To the extent legally permissible, the place of jurisdiction shall be the registered place of business of the Photographer.
